Summary
Series of documents dealing with a trial against capitan Guerra, accused of cowardice. Describes his surrender to Insurgentes. Prior to sentencing guerra takes asylum in a church. Judge Zozaya uses royal decree of October 7, 1775 to make extradition. Zozaya made to swear to priest that guerra will be returned to church alive. Guerra found guilty of cowardice, sentenced to remain 10 years in a castle with no military privileges. Sentence considered by Arredondo because of the military merits of guerra's sons, the sentence is changed to house arrest. (D. Bautista March, 1990).

Concerns prisoner who confesses his desertion in church. Diaz informs Castro of situation and asks what action to take. Reports that soldier gave false name and committed crime to avoid 8 year appointment in Havana. Needs to have permission to extract criminals from sacred places. Provides statements from witnesses. Lengthy legal case mainly consisting of sworn testimonies of numerous witnesses and involved parties in murder of Jose Contreras at presidio of Altamira by Manuel Cristoval Guzman. Documents include a statement or confession by Guzman who initially took asylum in church to avoid apprehension, later Guzman claimed protection under the Fuero militar. Guzman finally sentenced to five years public service in the presidios of Nuevo Santander. (G. Lavalley, may 1987)
